That the French People are the one and only master in the their own country. That both the totalitarian system and the system of the coalition of private interests that has worked against the national interest in our country should be simultaneously overthrown. That the imperative and closely linked goals of national security against the tyranny and perpetual violation should from now on be put into practice among us. That fellowship and mutual aid between all nations should be established. France occupying , in this international system, the distinguished place allotted to her by her worth and genius.

It being established that national sovereignty could not either legally or materially be exercised by the parliament in office, the duty of the assuming it falls to the nation itself. Once France is liberated, it will be for it's people to settle its political destiny and by means of free elections to provide themselves with the institutions and the men of their choice. It will therefore be necessary to create a provisional government whose function will be to make this electoral consultation possible, governing the country in the meantime.
A formidable task and one that will obviously bear with it the danger of exercising absolute power once again. It should be prudent to entrust this to a single person.

The above echoes in the works of Jefferson, Adams, Hamilton, Madison, Jay and Marshall. What was Constitutional or Government Theory is no longer an Experiment devised under God. The system which was established has been proven as a working model of law and governance.
What each of you have been devoided of is the question of what is Government? The answer is provided from Charles de Gaulle and Jules Jeanneney. Government begins with the individual, confessing Rights to themselves and others. This is the Nation or the mass of people establishing an order of protections for the individual and for the group.
This group then is the lone authority for what is the established nation, for without the People, there is not a nation and a nation can not exist without the system of established Rights, protected by arms.
What the Founders experienced as much as France, is that a regime can be established which makes criminals of the People to repress the People in order to dictate power. When the police state has established fear and intimidation to rule, the Government has ceased and the People's Rights are violated in their jailing, confinement and death.
The key in Charles de Gaulle is the phrase, "Worked against National Interest". National Interest is the Public's Interest and is rendered down again to the violation of what is the interest of the Individual in those unalienable Rights to Life, Liberty and the Pursuit of what makes the Individual happy in the responsible morals of a lawful People.
Senator Jenneneny goes on to further define the issue, that when a parliament, congress or regime has violated the National Interest or the Individual Rights, then as Charles de Gaulle affirmed, the parliament making criminals of the People, no longer is a representative of the People. That is something you should read again and think about, when a Congress, Executive and Judiciary start afflicting the People of those Rights, they no longer represent the People, and in that what they are ruling as is not legal. When this takes place, the Nation or the People, are then the sole authority of the Government and once they assemble themselves, a legal vote is then undertaken to elect a Government, by, for and of the People. The interloper being not of the People, for the People and by the People, for the People have re established the system of their authority in the vote of the governance by the majority and the rights of the minority.
In France, this the Committee of Free France. In America, it was the Continental Congress, deriving representatives from the Sovereign States. What would become James Madison's Constitution later and the Bill of Rights was quite specific in this Nation or the People. The Constitution limits all what the Federal can do. It establishes 3 base mandates of authority and it excludes the Federal system.
1. The Right of Speech, Assembly, Religion and the Press without restrictions. (1st Amendment)
2. The Right of Offense and Defense in being armed without infringement. (2nd Amendment)
3. The Right of the People in the 10th Amendment to retain all Rights not expressly stated in the Articles in limiting Congress, Judiciary and Executive.
It is the 10th Amendment which the French General and French President of the Senate are echoing in the Government is the People and when any regime rules against the People in intimidating them, it ceases to be legitimate.
This is not theory. This is the Law of a Free People.
All of this was hashed out in 1776, the Constitution and in Lincoln's War by force in violation of the Constitution and it appears it will be threshed out again in the coming staged world war.
