The New Mexico District Attorney has explained without explaining the charges which Alec Baldwin will face for murdering crew member. The thinking of the DA is broad and yet narrow. Her judgment is that anyone on the set was responsible for handling firearms safely.
Think of the DA's thoughts if a liberal like Michael Jackson dangled a baby over a balcony and dropped the kid. The DA is stating that actions matter, not like James Comey of the FBI stating that only Hillary Clinton's intent mattered, not her criminal actions.
So if someone like General Milley left a hand grenade in a children's playroom and a kid pulled the pin and it went off, Milley committed a criminal act.
This all comes down to not negligence, but actions that endangered others.
“Certain individuals may be criminally culpable for his/her actions and/or inactions on the set of Rust,” Carmack-Altwies told Deadline.
Carmack-Altwies asserted that she will “exercise my prosecutorial discretion to its fullest, including filing charges that are supported by probable cause.”
The district attorney further clarified that “everyone” handling firearms on the set of Rust had a duty to follow safety protocols.
“Everyone involved in the handling and use of firearms on the set had a duty to behave in a manner such that the safety of others was protected, and it appears that certain actions and inactions contributed to this outcome,” Carmack-Altwies the attorney said.
We know that Alec Baldwin as Producer and Actor engaged in criminal acts which endangered others.
As Producer it was his responsibility to spend the money for competent crews or enough crews so people were not over worked.
As a Producer, Baldwin was responsible for making certain the set was safe. As this was a Western and he hired a wrangler who had wild horses and someone got killed, that is Alec Baldwin's responsibility.
As an Actor, Alec Baldwin engaged in the following criminal acts:
- Alec Baldwin did not check and clear the firearm when presented to him.
- Alec Baldwin drew a firearm and cocked the hammer.
- Alec Baldwin drew a firearm and pointed it at other people.
Notice in this, that this has nothing to do with pulling the trigger, or letting a hammer fall as Baldwin stated in his ludicrous texts and interviews to save himself. What is of focus in this is, is that Alec Baldwin is facing a 5 count indictment, and those 5 counts will be in the degree of homicide, as this has surpassed negligence and by Baldwin's own admissions are linked to his deliberate actions.
In the volumes of Alec Baldwin's denials of felling guilt, not once did this future convicted murderer, state that he questioned, hesitated, stopped, drawing a weapon, cocking it or pointing it at people. Those 3 actions have not been denied by Alec Baldwin, and they are deliberate actions which he chose to engage in.
Put a like scenario into play to explain this. Say there was a couple sunning themselves on their lawn as neighbors of Alec Baldwin.
Alec Baldwin then appears, gets in his car, starts it, puts it into gear and runs the couple over, murdering them, but Alec Baldwin's response is, "I don't know how the car zoomed across the lawn as my foot was not on the accelerator."
The damning part of Alec Baldwin's excuses is a comment which refutes all Baldwin stated which was posted online.
I have the exact pistol Baldwin used. So I ran every experiment with it to explain his false narrative. The ONLY way the hammer goes forward when he released it is with his finger on the trigger. No other scenario works. There are three stops, including full cock. Without your finger on the trigger the hammer stops at each of the three. With your finger on the trigger the hammer drops at all three. Baldwin is lying. He cocked it and he pulled the trigger. Two separate actions.
As these crimes took place in New Mexico, the laws there are what defines all of this. In New Mexico, the penalty for reckless homicide, which is a 4th degree felony, is 18 months in prison. Five counts of reckless homicide is 80 months in prison or 6 years and 8 months in prison.
One can double that as everyone is overlooking that Alec Baldwin shot two people. Just because the male did not die, does not mean he was not injured. The charges would not be murder, but would weigh equally in assault as the male was assaulted by Alec Baldwin.
The reality is that Alec Baldwin could be facing 13 years and 4 months in prison. Balwin is 63 years old. Being found guilty would likely see Alec Baldwin die in prison, where safely tucked away he would not be shooting any other innocent people.
Baldwin's father died young, Alexander Rae Baldwin Jr. (October 26, 1927 – April 15, 1983), at age 56. Baldwin is already living on borrowed time. Alec Baldwin for taking another's life, even though he says he feels no guilt, a jury would find otherwise for this young Slavic woman which Baldwin murdered, and in multiple charges give Baldwin a life sentence.
The New Mexico DA has set the standard in what she is judging this case by. Alec Baldwin is responsible for this murder and for that he will be indicted.
Chances are Alec Baldwin will flee the United States as he fled New Mexico to avoid extradition. New Mexico should move to seize Alec Baldwin's passport as he is a proven flight risk.
