The Accused is not charged with having done something or having failed to do something, but solely with having been something...American jurisprudence recognizes no such principle so far as its own military personnel are concerned...No one would even suggest that the Commanding General of an American occupational force becomes a criminal every time an American soldier violates the law...one man is not held to answer for the crime of another

None of you have ever heard of Tomoyuki Yamashita, but what was done to him after World War II, was the basis of the hunting down of Americans after January 6th.

For historical sake, Tomoyuki Yamashita, was General Tomoyuki Yamashita, who earned the title of The Tiger of Malay, in routing the English in south Asia for control of Singapore. The British have never been wiped from the field, the way General Yamashita cleansed Asia of them.

The fortunes of Japan did not though continue as Japan was out manufactured by the United States and in the end, the great beginning of the war in General Douglas MacArthur being driven from the Philippines had General Yamashita ordered to take command of those islands to try and save Japan from American advancement.

Yamashita had 3 armies on the Philippines, and as the Americans advanced, he lost communication with the commanders, and in retreating from Manila had his orders to leave the city violated by Admiral Iwabuchi.



while he evacuated most of his soldiers northward Imperial Japanese Navy Rear Admiral Sanji Iwabuchi re-occupied Manila with 16,000 sailors, with the intent of destroying all port facilities and naval storehouses. Once there, Iwabuchi took command of the 3,750 Army security troops, and against Yamashita's specific order, turned the city into a battlefield. The battle and the Japanese atrocities resulted in the deaths of more than 100,000 Filipino civilians, in what is known as the Manila massacre,


The General actually fought in the Philippines until September 2, 1945 AD in the year of our Lord in delaying tactics against the United States. His was the last command to surrender to the United States as his army had been whittled away to nothing.

General Yamashita's surrender though was not American at all. Yes he was treated with respect and protected, but he was charged with being a war criminal. As much as I admire General MacArthur, what took place in the framing of General Yamashita was completely unAmerican.

Yamashita in his own words stated that what he was being charged with, General MacArthur and every American leader could be hung for.


My command was as big as MacArthur's or Lord Louis Mountbatten's. How could I tell if some of my soldiers misbehaved themselves? It was impossible for any man in my position to control every action of his subordinate commanders, let alone the deeds of individual soldiers. The charges are completely new to me. If they had happened, and I had known about them, I would have punished the wrongdoers severely. But in war someone has to lose. What I am really being charged with is losing the war. It could have happened to General MacArthur, you know


His American defense attorney summed up the charges in, General Yamashita was being prosecuted not for any crimes he ordered, but for being General Yamashita. For Douglas MacArthur returning to the Philippines and accepting the surrender of Japan, Douglas MacArthur was denied victory in the Philippines weeks after the war was over. This is the underlying pretense of the murder of this Japanese General, he simply would not due to honor, quit on his People.



More is at stake than General Yamashita's fate. There could be no possible sympathy for him if he is guilty of the atrocities for which his death is sought. But there can be and should be justice administered according to the law. ... It is not too early, it is never too early, for the nation steadfastly to follow its great constitutional traditions, none older or more universally protective against unbridled power than due process of law in the trial and punishment of men, that is, of all men, whether citizens, aliens, alien enemies or enemy belligerents.

This went all the way to the Supreme Court and in order to make this murder legal,  a precedent was set with fake witnesses like those arrayed against Jesus in the Sanhedrin by the Jews, whose stories did not match or were denied, but ending with the Constitutional violation of in the Yamashita Standard, which stated that any leader could be executed for the acts of their subordinates, even when they were ignorant of the war crimes the subordinates were engaged in.......IN ANOTHER MILITARY BRANCH OF SERVICE.

This joins the anti Constitutional finding of William Barr for HW Bush which created kidnapping of foreign leaders to be tried before American courts for breaking American laws, as in Panamanian President, Manuel Noriega.

General Yamashita in his last words revealed the real depth of his soul in not condemning his murderers, but instead thanking them and asking the gods of Japan to bless them.

The Japanese non Christian was the greatest practitioner of Christian mercy in the room.

 

As I said in the Manila Supreme Court that I have done with my all capacity, so I don't ashame [sic] in front of the gods for what I have done when I have died. But if you say to me 'you do not have any ability to command the Japanese Army' I should say nothing for it, because it is my own nature. Now, our war criminal trial going under your kindness and right. I know that all your American and American military affairs always has tolerant and rightful judgment. When I have been investigated in Manila court I have had a good treatment, kindful attitude from your good natured officers who protected me all the time. I never forget for what they have done for me even if I had died. I don't blame my executioner. I'll pray the gods bless them. Please send my thankful word to Col. Clarke and Lt. Col. Feldhaus, Lt. Col. Hendrix, Maj. Guy, Capt. Sandburg, Capt. Reel, at Manila court, and Col. Arnard. I thank you



This is the Easter story of the Jesus of Japan.


Former war crimes prosecutor Allan A. Ryan has argued that by order of General MacArthur and five other generals, and the Supreme Court of the United States, Yamashita was executed for what his soldiers did without his approval or even prior knowledge. The two dissenting Supreme Court Justices called the entire trial a miscarriage of justice, an exercise in vengeance, and a denial of human rights
